Subcontracting: Can I subcontract as a registered provider?

The short answer.

Yes — the Commission's guidance calls the arrangement facilitation or brokerage, and it is allowed. What it does not do is move the responsibility: the registered provider claims the payment and answers for everything delivered under its registration, including the parts a subcontractor delivered.

So a subcontracting arrangement is a registration question before it is a commercial one. The registered provider's own conditions of registration follow the work out to whoever performs it, and the participant has to be told who is responsible for their supports.

Some providers have 'facilitation' or ‘brokerage’ arrangements for delivering supports and services. This is where an unregistered provider deliver supports under another providers registration. The unregistered provider may be an entity, sole trader or subcontracted employee or worker.

When this happens, the registered provider: must be the one that claims payment for supports and services is responsible for all supports and services delivered under their registration, including those delivered by the contracted provider
